When it applies
- You're paid, gifted, or comped for a post.
- You have any 'material connection' to a brand you mention — employment, free product, affiliate commission, family ties.
- You're the brand running an influencer campaign — you're responsible for making sure your creators disclose, too.
Whose responsibility
The person posting (the creator) AND the brand paying them. PitchIQ generates the disclosure; you're responsible for keeping it in the post.

The FTC's #1 rule is 'clear and conspicuous' — the disclosure has to be hard to miss. Buried in a wall of hashtags at the bottom doesn't count. PitchIQ puts it at the top of the caption draft for that reason.

When it applies
- You're referencing a fundraise — even casually — in outbound messages.
- You're soliciting investment in a private company or fund.
- You're sending a deck, intro email, or DM that mentions raising money.
Whose responsibility
The person raising money (the founder / issuer). PitchIQ appends the disclaimer to investor-outreach drafts; whether you can solicit a given person at all (accredited vs. not) is on you.

506(b) bars general solicitation entirely — you can only approach people you have a pre-existing relationship with. 506(c) permits public solicitation but requires you to verify every investor is accredited. The disclaimer text does not change which rule you're under; that's a structural decision to make with your counsel before you start outreach.

When it applies
- Every commercial email you send through PitchIQ — pitches, follow-ups, sequence steps, AI-drafted replies.
Whose responsibility
The sender (you). PitchIQ handles this automatically — but only once you've set your mailing address.

Two requirements: (1) a valid physical postal address in every message, (2) a working unsubscribe mechanism honored within 10 business days. PitchIQ adds both automatically — the address comes from Settings → Mailing address, and the unsubscribe link is a per-recipient signed URL that also satisfies Gmail/Yahoo's one-click (RFC 8058) bulk-sender requirement.

- Any SMS you send through PitchIQ's Twilio integration.
Whose responsibility
The sender (you). PitchIQ enforces most of this server-side — quiet hours, STOP/HELP/START keywords, double opt-in — but A2P brand registration is your responsibility.
